IV. LEGAL DISCLAIMER

1. NATURE OF SERVICES

Vamble (“the Platform”) is a proprietary, international Software-as-a-Service (SaaS) platform operated by Vamble, Inc. (“Vamble”, “we”, “us”, or “our”). Vamble exclusively facilitates the virtual connection of individual users (“Users”, “Players”, “Participants”) at least 18 years of age or the legal age of majority (whichever is greater) who voluntarily engage in peer-to-peer skill-based video game challenges (“Contests”). Vamble operates solely as a technology provider and neutral intermediary, facilitating Contests and operationally restricting and releasing funds through ledger-based controls.

Vamble does not:

  • act as a trustee, custodian, fiduciary, or legal escrow agent, and does not hold User funds in trust.
  • provide, offer, or promote any game, Contest, or activity determined by chance, luck, or random outcome.
  • act as a bookmaker or house in any Contest or participate in any outcome.
  • provide money transmission services to consumers as a standalone product; any movement of funds is incidental to facilitating Contest participation and Settlement through Vamble’s internal ledger and third-party payment processors, as described in the Wallet & Funds Terms.
  • permit, encourage, or facilitate betting on events of chance or any illegal activity.
  • offer wagering to minors or individuals under the legal wagering age in their jurisdiction.

2. NO GAMES OF CHANCE; GAMES OF SKILL ONLY

All challenges, Stakes, and Contests arranged through Vamble are strictly limited to games of skill, where the outcome is predominantly determined by the superior knowledge, training, attention, experience, and/or ability of the participating Players. Any activity or Contest with an outcome determined wholly or predominantly by chance is strictly prohibited and is not supported by Vamble. Users found to be violating this policy may be permanently banned and reported to relevant authorities.

3. VAMBLE AS TECHNOLOGY PROVIDER & NEUTRAL INTERMEDIARY

Vamble acts solely as:

  • A neutral facilitator providing a virtual meeting ground and digital tools to Players who choose to compete against each other in skill-based video game Contests.
  • A neutral intermediary that applies operational Settlement controls through its internal ledger to temporarily restrict and release User funds pending verification of skill-based Contest outcomes.
  • Vamble does not participate in, influence, or profit from the outcome of any individual Contest beyond transaction or platform fees expressly disclosed to the user.

4. USE OF FUNDS

Funds deposited by Users are held in pooled or aggregate accounts and may be commingled and used for Vamble’s lawful treasury and operational purposes, as described in Section V. (Wallet & Funds Terms), including Section V. 16 (Aggregate Accounts and Treasury Use Disclosure) and Section V. 17 (No Interest Payable to Users; Float and Earnings Retained by Vamble). Users’ rights with respect to Wallet Balances are contractual and are subject to the withdrawal conditions and restrictions described in Section V.

5. GEOGRAPHIC AND JURISDICTIONAL RESTRICTIONS

5.1 No Representation or Warranty

Vamble makes no representation or warranty as to the legality of its services in any specific jurisdiction. It is the sole responsibility of each user to determine and comply with the laws and regulations of their respective country, state, province, territory, or jurisdiction.

By accessing or using Vamble, you represent and warrant that:

  • You are of legal age to engage in skill-based wagering in your jurisdiction.
  • Your participation in Contests and wagering via Vamble is lawful in your jurisdiction.
  • You are not located in a country, state, or region where skill-based wagering is prohibited.

5.2 United States

Vamble does not offer or facilitate any Contest that constitutes “gambling” under U.S. federal or applicable state law. All Contests are skill-based. Users from certain U.S. states may be prohibited from participating, subject to ongoing legal review. Users are responsible for ensuring compliance with all applicable federal, state, and local laws.

5.3 European Union (EU)

Vamble does not make any representation that its services are lawful in any specific EU member state. Vamble may restrict or geo-block access where legal requirements are unclear, evolving, or under review, or where any form of online stake-based competition is restricted. Users are solely responsible for confirming legality and compliance in their country of residence.

5.4 United Kingdom

Vamble does not make any representation that its services fall outside the scope of U.K. gambling or gaming laws in all circumstances. Vamble operates skill-based Contests only and does not offer casino, lottery, or chance-based products. Users must be 18 or older and are solely responsible for confirming legality and compliance in their location. Vamble may restrict or block access in the U.K. based on legal or regulatory requirements.

5.5 Canada

Vamble does not make any representation that its services are lawful in any province or territory. Users are solely responsible for confirming legality and compliance in their province or territory. Vamble may restrict or geo-block access in jurisdictions where legal requirements are unclear, evolving, or under review, or where skill-based stake contests are restricted.

5.6 Australia

Vamble operates only for skill-based Contests and does not provide any form of wagering on events of chance or mixed chance and skill. Users must comply with the Interactive Gambling Act 2001 and all state or territory legislation.

5.7 Rest of World

For all other jurisdictions, it is the sole responsibility of the user to determine that participation in skill-based Contests is lawful.

Vamble reserves the right, in its sole discretion, at any time and without notice, to restrict or terminate access to the Platform from any jurisdiction it determines necessary or prudent for legal, regulatory, or risk reasons.

6. NO USE BY MINORS OR PROHIBITED PERSONS

You must be at least 18 years of age, or the legal age of majority in your jurisdiction, whichever is greater, to access or use Vamble’s services and Platform. Minors and otherwise prohibited persons are strictly barred from participation. Accounts found to be in violation will be terminated.

7. NO ADVICE, ENDORSEMENT, OR GUARANTEE

Vamble provides no legal, financial, or tax advice. Users are encouraged to seek independent professional advice regarding the legality and tax implications of their activities. Vamble does not guarantee the outcome of any Contest, the ability of any user to participate, or the legality of services in any jurisdiction.

Any statistics, rankings, projections, or other analytics displayed on the Platform are informational and entertainment-only, may be inaccurate, are not “odds” or wagering advice, and must not be relied upon as professional advice or as a guarantee or prediction of outcomes.

8. USER RESPONSIBILITY AND INDEMNIFICATION

By using Vamble, you accept full responsibility for compliance with all applicable laws and regulations, including but not limited to, those related to online skill gaming, money transmission, anti-money laundering, tax reporting, and currency exchange. You agree to indemnify, defend, and hold harmless Vamble, its officers, directors, employees, and agents from any and all claims, liabilities, losses, or damages arising from your use of the Platform in violation of this disclaimer or applicable law.

9. ANTI-MONEY LAUNDERING (AML), KNOW YOUR CUSTOMER (KYC), AND FRAUD PREVENTION

Vamble implements appropriate AML, KYC, and fraud prevention protocols in accordance with best practices and applicable laws. Users must provide accurate identification and banking information, and agree to all checks required by law or by Vamble policy. Any suspected fraud, money laundering, or illegal activity will be reported to the appropriate authorities.

10. CRYPTOCURRENCY AND CURRENCY EXCHANGE

Where permitted, Vamble may facilitate Stake and payouts in both fiat and certain cryptocurrencies. All users are responsible for ensuring that use of cryptocurrency is lawful in their jurisdiction, and for compliance with any tax, reporting, or exchange control requirements.

11. AMENDMENTS AND SEVERABILITY

Vamble reserves the right to amend, update, or modify this disclaimer at any time without prior notice. If any provision herein is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
